New Constitution Adopted for Athletic Council

THROUGH THE CONCORDANT action of the Board of Trustees, the Alumni Council, and Palaeopitus a revised constitution has been put into effect for the use of the Athletic Council. A committee consisting of Dr. A. H. Ruggles 'O2, Richard Parkhurst 'l6, and L. K. Neidlinger '23, representing the various groups concerned in the revision, worked over a period of more than a year studying the best form of organization for the Council Authority for the activities of the Council is now definitely placed in the hands of the Trustees from whom it may be passed on to the Council. This provision is explained in Article II of the constitution, which is reprinted in full herewith:

ARTICLE I

1. Name

This body shall be known as the Dartmouth College Athletic Council.

ARTICLE II

1.Purpose

The purpose of the Athletic Council shall be to act under the authority of the Trustees of Dartmouth College for the administration of athletics in accordance with the powers delegated from time to time by vote of the Trustees, and particularly by vote of the Trustees dated October 29, 1934, as follows: "That under a 'Constitution of the Dartmouth College Athletic Council' dated October 15, 1934, and hereby approved, the Athletic Council is authorized to organize, direct, supervise and manage all athletic activities of Dartmouth students such as involve the representation of Dartmouth College in competition with the representatives of other academic institutions or organizations, or otherwise as this authority may from time to time be modified or enlarged; and further, that the Athletic Council is authorized to provide for the separate maintenance of funds for its operations, with suitable reserves, with the understanding that at the close of each fiscal year an audited financial statement shall be submitted to the Trustees."

ARTICLE 111

1. Composition

The Athletic Council shall consist of three alumni, three members of the faculty, and three undergraduates.

2. Election

a. An Alumni member shall be nominated and elected by the Alumni Council. He shall enter upon his duties at the first meeting of the ensuing academic year and shall serve for a term of three years. He shall not be eligible for election for more than two successive terms, including any term for which he was elected to fill a vacancy.

b. A faculty member shall be a member of the Faculty Committee on Athletics, and shall be elected by the faculty. He shall enter upon his duties at the first meeting of the ensuing academic year and shall serve for a term of three years. He shall not be eligible for election for more than two successive terms, including any term for which he was elected to fill a vacancy.

c. An undergraduate member shall be elected by the Athletic Council at the last meeting of the academic year from a list of six undergraduates nominated by Palaeopitus from the varsity and freshman managers succeeding to office the following academic year. He shall serve for the ensuing academic year.

and. At the time of the adoption of this Constitution members elected under the superseded Constitution shall continue in office until the expiration of the terms for which they were elected.

3. Vacancies

In case of a vacancy under Article 111-2-a, the Alumni Council shall appoint a successor for the unexpired term. In case of a vacancy under Article 111-2-b, the faculty shall appoint a successor for the unexpired term. In case of a vacancy under Article 111-2-c, the Athletic Council shall appoint a successor for the unexpired term.

ARTICLE IV

1. Officers

a. The officers of the Athletic Council shall be a President and a Secretary.

h. The President shall be elected at the last meeting of the Athletic Council held before the expiration of the academic year and shall serve for one year.

c. The Secretary shall be elected by the Athletic Council for such term as it may designate. He shall be a resident of Hanover.

and. The duties of the President and Secretary shall be those usually pertaining to such offices, and such others as the Athletic Council shall designate.

2. Executive Officer

The Athletic Council may appoint or employ an executive officer, designate his title and establish his duties.

g. Treasurer

The Athletic Council shall, with the approval of the Trustees, appoint a Treasurer for such terms as the Athletic Council may designate, and shall establish his duties.

4. Coaches, Trainers, Managers and Others:

a. The Athletic Council shall appoint all coaches, trainers, undergraduate managers, and such other persons as it may believe necessary for the proper training and supervision of teams under its administration; and shall establish their duties. When any compensation is to be paid to any of such persons, the Athletic Council shall fix such compensation.

b. The Athletic Council, at any regular meeting, may by a two-third vote remove from office any person appointed or employed under Article IV-4-a when such removal is believed by the Athletic Council to be in the best interests of the College.

ARTICLE V

i. Meetings:

a. Regular meetings of the Athletic Council shall be held at the call of President or Secretary. All members shall be notified of such meetings in writing, and notification shall include an outline of the business to be considered. Five members present shall constitute a quorum for a regular meeting provided that one alumni member, one faculty member, and one undergraduate member shall be present.

b. Special meetings of the Athletic Council shall be held at the call of the President or Secretary. Five members present shall constitute a quorum. Copies of the minutes of special meetings shall be sent to members not present.

c. No member of the Athletic Council not present at a meeting may vote by proxy, but when submitted to the Secretary in writing the vote of an absent member on a specific question shall be recorded as though he Were present.

ARTICLE VI

1. Eligibility

The Athletic Council shall establish rules of eligibility for participation in intercol- legiate athletics.

ARTICLE VII

1. Insignia

The Athletic Council shall provide for insignia to be awarded for meritorious participa- tion in intercollegiate athletics, and shall prescribe the conditions under which such insignia shall be awarded.

2. Historical Record

The Athletic Council shall maintain an historical record of Dartmouth activities in athletics.

3. I?idividual Track and Field Records

The Athletic Council shall determine when a Dartmouth track, field or other athletic record has been equalled or broken, and shall provide individual certificates in such cases.

ARTICLE VIII

1. By-Laws

The Athletic Council shall establish By-Laws which may be amended by six votes at any regular meeting.

ARTICLE IX

1. Amendments

This Constitution, effective January 1, 1935, adopted by the concordant action of the Trustees of the College, the Alumni Council and Palaeopitus, may be amended only by the concordant action of these bodies. The original copy, signed by the duly authorized officers of each body, is filed with the Trustees of the College, and any amendment shall not be in effect unless and until so filed.
