College lawyers have responded to a lawsuit filed by three of the so-called "shanty bashers" with a motion for dismissal. The 48-page motion asked that the case be dismissed on the grounds that the plaintiffs failed to prove the College acted as an arm of the government. Sean Gorman '76, assistant to the College counsel, said, "The claims they've made are only applicable to the government. Private institutions are not subject to such claims."
Last July, Deborah Stone '87, Frank Reichel III '86, and Teresa Polenz '87 filed suit in the U.S. District Court in Concord claiming their constitutional rights were violated when the College took disciplinary action against them after they were found guilty of attacking anti-apartheid shanties on the Green nearly two years ago.
