After a couple of years at Dartmouth, Upham read the law in his father's Claremont New Hampshire, office and moved to Cincinnati, Ohio. When a war for independence broke out in Texas, Upham enlisted in General Sam Houston's army and eventually attained the rank of major. His command, led by Colonel David Crockett, was wiped out in the Alamo massacre in 1836.
